1. Overview

Welcome to NinjaSIM. The terms "we," "us," and "our" refer to NinjaSIM. We operate ninjasim.com and provide travel eSIM data plans and related services (the "Services").

By using our website or purchasing our products, you agree to these Terms of Service and our Privacy Policy. If you do not agree, please do not use our Services.

2. Nature of Our Service

NinjaSIM is a reseller of eSIM data plans. We are not a mobile network operator (MNO) and do not own, operate, or control any telecommunications infrastructure or cellular networks. Our eSIM plans connect you to third-party mobile networks in your destination country.

Because we rely on third-party network operators to deliver connectivity, we cannot guarantee specific data speeds, uninterrupted service, network availability in every area of a country, or that service will be free from outages, throttling, or degradation. Network performance depends entirely on the local carrier's infrastructure, capacity, and conditions at your location.

We act as an intermediary between you and the underlying network provider. Any connectivity issues related to the carrier's network — including but not limited to coverage gaps, congestion, maintenance, outages, speed variations, or changes to the carrier's service — are outside our control and responsibility.

3. Eligibility and Accounts

By using our Services, you confirm that you are at least 18 years old or the age of majority in your jurisdiction. If you create an account, you are responsible for maintaining its security and for all activity under it. You may not transfer or assign your account to another person.

All information you provide must be accurate, current, and complete.

4. Our Products

NinjaSIM provides digital eSIM data plans for international travel. Our products are:

  • Digital-only — delivered instantly via email as a QR code after purchase
  • Data-only — they do not include voice calls or SMS (you can use apps like WhatsApp and FaceTime over your data connection)
  • Single-use — each eSIM is for one-time use and cannot be topped up, transferred, shared, or reused
  • Time-limited — plan validity begins when the eSIM first connects to a network at your destination, not at the time of purchase
  • Non-transferable — plans are for your personal use only and may not be resold

Data allowances and validity periods are as stated on the product listing at the time of purchase. We reserve the right to change pricing, modify plans, or discontinue any product at any time without prior notice.

5. Device Compatibility

eSIM technology requires a compatible, carrier-unlocked device. It is your responsibility to verify before purchasing that:

  • Your device supports eSIM
  • Your device is not carrier-locked
  • Your device meets the requirements listed on our website

We provide a compatibility checker on our website as a guide, but it is not exhaustive and does not constitute a guarantee. NinjaSIM is not responsible for purchases made for incompatible or locked devices.

6. Orders and Payment

When you place an order, you are making an offer to purchase. We reserve the right to accept or decline any order at our discretion. Your order is confirmed once payment is processed and you receive a confirmation email with your QR code.

You agree to provide accurate payment information and that all charges will be honored by your payment provider. Prices are as displayed at the time of purchase. Taxes may apply depending on your location.

We reserve the right to cancel orders, correct pricing errors, or limit quantities at any time.

7. Delivery

All NinjaSIM products are delivered digitally via email immediately after purchase. Your QR code and installation instructions are included in your order confirmation email. If you do not receive your email within a few minutes, check your spam folder or contact us.

Once the confirmation email containing your QR code has been sent, delivery is considered complete. We are not responsible for emails that are filtered, blocked, or undelivered due to your email provider's settings.

8. Refunds

All purchases are subject to our NinjaSIM Satisfaction Promise, as detailed in our Refund Policy.

Refunds for non-activated eSIMs: If your eSIM has not been activated (i.e., it has not connected to a mobile network), you may request a full refund within 5 days of the original purchase date. Simply scanning the QR code or installing the eSIM profile on your device does not count as activation — refund eligibility is based on whether the eSIM has connected to a network and begun using data.

Device compatibility: If your device is incompatible with eSIM technology, you may request a full refund within 5 days of purchase, even if installation was attempted.

Activated eSIMs: Because eSIMs are digital products that are consumed upon activation, activated eSIMs are non-refundable. An eSIM is considered "activated" once it has successfully connected to a mobile network. For activated eSIMs experiencing technical issues, NinjaSIM will provide troubleshooting support or a replacement eSIM at no additional charge.

Refund requests made after 5 days from the purchase date will not be honored. All refund requests must be submitted via WhatsApp (+1 646-714-7386) or email (support@ninjasim.com) with the associated order number.

9. Service Limitations and Disclaimers

You acknowledge and agree that:

  • Data speeds are determined by the local network operator and may vary based on location, network congestion, time of day, and other factors beyond our control
  • Coverage maps and country availability are approximate and do not guarantee service at every location within a listed country
  • Certain local regulations, carrier policies, or government actions may restrict, limit, or block specific services or content in some countries
  • We may need to change the underlying network provider for any destination without notice, which may affect coverage or performance
  • Temporary service interruptions may occur due to carrier maintenance, technical issues, or force majeure events
  • Data usage reported by your device may differ from usage recorded by the network, and the network's measurement is authoritative

10. Acceptable Use

You may use our Services for lawful, personal purposes only. You may not:

  • Use our products for commercial resale or redistribution
  • Attempt to reverse-engineer, modify, clone, or tamper with our eSIM products or QR codes
  • Use our eSIM plans for any illegal activity, including circumventing local laws or regulations
  • Access or use our Services in any way that violates applicable laws
  • Interfere with the operation of our website or Services
  • Impersonate another person or provide false information
  • Collect personal information of other users
  • Transmit viruses, malware, or other harmful code
  • Abuse the network through excessive automated traffic or activities that degrade service for other users

We reserve the right to suspend or terminate your access and void your eSIM plan without refund if you violate these terms.

11. Intellectual Property

All content on our website — including text, graphics, logos, images, and software — is owned by NinjaSIM or its licensors and is protected by intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from our content without written permission.

The NinjaSIM name, logo, and branding are our trademarks and may not be used without prior consent.

12. Third-Party Links and Services

Our website may contain links to third-party websites or integrate third-party services. We are not responsible for the content, policies, or practices of any third-party sites or services. Your use of third-party services is at your own risk and subject to their terms.

13. Feedback

If you submit reviews, suggestions, or other feedback to us, you grant NinjaSIM a non-exclusive, royalty-free, perpetual license to use, reproduce, and publish that feedback for any business purpose. You confirm that any feedback you provide is your own and does not violate the rights of others.

14. Disclaimer of Warranties

OUR SERVICES AND PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

AS A RESELLER, WE DO NOT WARRANT OR GUARANTEE THE PERFORMANCE, RELIABILITY, AVAILABILITY, OR QUALITY OF ANY THIRD-PARTY MOBILE NETWORK. WE MAKE NO REPRESENTATIONS REGARDING DATA SPEEDS, NETWORK UPTIME, COVERAGE AREAS, OR THE SUITABILITY OF OUR PRODUCTS FOR ANY SPECIFIC PURPOSE.

15. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, NINJASIM AND ITS AFFILIATES, PARTNERS, OFFICERS, AND EMPLOYEES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOST DATA, LOSS OF BUSINESS OPPORTUNITIES, MISSED TRAVEL CONNECTIONS, INABILITY TO ACCESS SERVICES OR APPLICATIONS, OR ANY DAMAGES RESULTING FROM NETWORK UNAVAILABILITY — ARISING FROM YOUR USE OF OUR SERVICES OR PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF OUR SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC PRODUCT GIVING RISE TO THE CLAIM.

16. Indemnification

You agree to indemnify and hold harmless NinjaSIM and its affiliates, officers, and employees from any claims, damages, or expenses (including legal fees) arising from your breach of these Terms, your violation of any law, or your use of our Services.

17. Force Majeure

We shall not be liable for any failure or delay in providing our Services caused by events beyond our reasonable control, including but not limited to natural disasters, government actions, carrier outages, network failures, sanctions, pandemics, cyberattacks, or disruptions to third-party infrastructure.

18. Changes to These Terms

We may update these Terms at any time. Material changes will be posted on this page with an updated date. Your continued use of our Services after changes are posted constitutes acceptance of the revised Terms.

19. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

20. Governing Law

These Terms are governed by the laws of the United States. Any disputes arising from these Terms or your use of our Services will be resolved in the applicable courts of the United States.
